Welcome to AvatarAI, operated by DIGITGEMS INTERNATIONAL LIMITED. By using our AI Headshot Generation Service, you agree to these Terms of Service.

1. Service Description

AvatarAI provides an AI-powered headshot generation service. Users upload photographs and select artistic styles, and our AI generates enhanced portrait images based on those inputs.

2. User Accounts

You must create an account to use our Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to create an account.

3. Credits and Payment

  • Credits are required to generate AI headshots. Each generation costs 1 credit.
  • New accounts receive 2 free credits upon registration.
  • Additional credits can be purchased through our pricing plans.
  • All payments are processed securely through Stripe.
  • Credits are non-transferable and cannot be exchanged for cash.

4. Uploaded Content

You represent and warrant that:

  • You own the photos you upload or have permission to use them
  • The photos do not violate any third party's rights
  • You have consent from any identifiable individuals in the photos
  • The photos do not contain illegal, harmful, or offensive content

We reserve the right to refuse processing any photos that violate these terms.

5. AI-Generated Content

  • You own the AI-generated headshots produced from your uploaded photos, subject to your purchased plan's terms.
  • Commercial use of generated images requires a Pro or Enterprise plan.
  • We do not guarantee that AI-generated images will meet any specific quality standard or be suitable for any particular purpose.
  • AI-generated results may vary based on input photo quality and selected style.

6. Prohibited Uses

You agree NOT to use the Service to:

  • Generate images of other people without their consent
  • Create misleading, fraudulent, or deceptive content
  • Generate illegal, harmful, threatening, or harassing content
  • Violate any applicable laws or regulations
  • Attempt to reverse engineer or compromise our AI systems
  • Resell or redistribute generated images without appropriate licensing

7. Intellectual Property

The Service, including its software, AI models, and design, is owned by DIGITGEMS INTERNATIONAL LIMITED and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated results will meet your expectations.

9. Limitation of Liability

To the maximum extent permitted by law, DIGITGEMS INTERNATIONAL LIMITED shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

10. Termination

We may suspend or terminate your account for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

11. Changes to Terms

We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the updated Terms.
